Terms of Service

By accessing or using Dentisfy platform (the "Service"), you agree to comply with these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Eligibility

1.1 The Service is exclusively for dental professionals (dentists, lab technicians, or verified industry members). By registering, you confirm your professional status.

1.2 Dentisfy reserves the right to request proof of credentials (e.g., dental license, business registration) and suspend unverified accounts.

2. Privacy & Data Security

2.1 GDPR/HIPAA Compliance:

  • All user data is encrypted (AES-256) and stored in secure servers.
  • We adhere to EU GDPR and HIPAA (where applicable) for data protection.

2.2 Patient Confidentiality:

  • Do not share identifiable patient information (names, addresses) on the Service.
  • Use anonymized case IDs (e.g., "Case #X123") when discussing cases.
  • Violations may result in account termination.

2.3 Data Use:

  • User data is never sold to or share with third parties.

3. User Responsibilities

3.1 Accurate Information: Provide truthful professional details. Misrepresentation voids these Terms.

3.2 Content Ownership: You retain rights to uploaded scans/case data but grant Dentisfy a license to process them for Service functionality.

3.3 Prohibited Conduct:

  • Sharing login credentials.
  • Reverse-engineering or scraping platform data.
  • Uploading malicious files or unlawful contents.

4. Lab/Supplier Transactions

4.1 Dentisfy as Transactional Agent:

  • Dentisfy operates as the primary contracting party for all lab services. Dentists place orders with Dentisfy, and we assign cases to pre-vetted labs/technicians based on specialty, capacity, and quality metrics.
  • Dentists can see case progress and quality ratings.

4.2 User Responsibilities:

  • Dentists must provide accurate scan data, (silicon impressions/stone models), and clinical instructions.
  • Labs/Technicians must adhere to Dentisfy’s quality standards and turnaround times.

4.3 Dispute Resolution:

  • Dentisfy handles all remakes, refunds, and quality disputes internally.
  • Dentists can submit complaints, feedback and ratings via the platform.

4.4 Pricing & Payments:

  • Dentists agree to pay Dentisfy directly. Fees may include.
    • Lab production costs.
    • Cost of materials, equipment, devices and other dental products when applicable
    • Dentisfy's service fee (transparently itemized).
    • Freight and insurance
    • Local tariffs (when applicable)

5. Limitation of Liability

5.1 Clinical Outcomes:

  • Dentisfy acts solely as a transactional and matchmaking platform. We are not liable for:
    • Clinical outcomes of dental prosthetics, including but not limited to fit, function, or biocompatibility.
    • Patient injuries, damages, or legal claims arising from the use of products ordered through the Service.
  • Dentists assume full responsibility for:
    • Verifying prescriptions and case specifications submitted to labs.
    • Obtaining patient consent for treatments.
    • Final inspection, adjustment, and placement of all restorations

5.2 Dentist-Patient Litigation:

  • In the event of patient lawsuits related to lab-fabricated products:
    • Dentists agree to indemnify Dentisfy against all claims, damages, or legal costs.
    • Dentists must resolve disputes directly with patients; Dentisfy is not a party to such proceedings.
  • Dentists warrant they carry professional liability insurance covering restorations sourced through third parties.

5.3 Labs/Suppliers:

  • Labs must guarantee compliance with local dental regulations.
  • Labs must comply to:
    • Request material certifications (e.g., CE/FDA) for high-risk cases.
    • Retain all case documentation (scan files, prescriptions) for 10+ years.

5.4 Financial Limitations:

  • Dentisfy's maximum liability for any claim is limited to 100% of fees paid by the user in the preceding 6 months.
  • Excluded damages: Lost profits, reputational harm, or consequential damages.

5.5 Enforcement Mechanism:

  • Mandatory Arbitration: All disputes must first undergo mediation via [Neutral Arbitration Service].
  • Governing Law: Claims subject to laws of Hong Kong SAR, excluding conflict-of-law principles.

5.6 User Acknowledgment:

By using Dentisfy, dentists confirm they:

Understand they bear sole clinical responsibility for patient outcomes.

Agree to waive Dentisfy from liability for patient litigation.

Will notify Dentisfy immediately of any product safety concerns.

6. Termination

6.1 Dentisfy may suspend accounts for:

  • Breaching patient confidentiality.
  • Fraudulent activity.
  • Violating professional ethics.

6.2 Users may delete accounts anytime via Settings.

7. Governing Law

Disputes will be resolved under the laws of Hong Kong SAR.

Acceptance: By clicking "I Agree," you confirm:

  • You are a dental professional.
  • You will protect patient privacy.
  • You accept these Terms.
